because the council have to make there decisions based on the facts, the facts will be it was tried and it failed, if the council then decide not to do what they want they can take it higher, and again the decision will be based on the facts.

Did you see that planning program on bbc (i think) about 8pm a couple of weeks ago, where a guy applied for pp to build an extension, but ended up knocking the house down and completely rebuilding (much bigger), now everyone on the planning commitee knew what he did and why but still had to vote yes to the retrospective planning permission.

They are playing the game, no doubt they would love someone to really try as the business rates they have to pay now must be stinging them quite a bit.
