Has the fence come down yet ??

Hi All

Can anybody tel me if that fence has been taken down yet as per the instruction from the council after the planning permision was rejected .

It was still standing at the weekend when I visited. Also, and perhaps of more immediate concern as it is a listed building, the 'DREAMLAND' sign has not been replaced on the cinema building.

I totaly agree Nick . Where do we stand on this do they have to make sure it goes back up in certain time frame or is it like it always seems to be when they are ready and have done all the damage they can.

There is no fixed time frame, but I would have thought about three weeks would be reasonable. I think that the Council should now be considering formal action against the owners.

Do we know what form of action they could legaly take and if i was to cantact them by way of there website who would be the best person to cantact.

The council would need to serve a listed building enforcement notice under section 38 of the Planning (Listed Buildings and Conservation Areas) Act 1990. This will give the owner 28 days to reinstate the sign, after which prosecution would take place. There is a right of appeal to this notice.

Don't worry too much about the fence. The Council has four years in which to serve an enforcement notice as it is unauthorised development. I am sure that they will take action at the appropriate time.

The sign could have been "lost" the same fate befell an enitre pavilion that used to sit on Brightons Palace pier.

It doesn't matter what anyone thinks is reasonable. That's not how this stuff works.
There must be some provision for this in the council rules/the law. If not, then it's up to the council to impose a timeframe and enforce it.

It would be unreasonable of Thanet District Council to refuse to let the owners of the Dreamland cinema take the sign down for maintenance. They should therefore be allowed a reasonable period of time for maintenance. In my opinion, that time is now over and the Council needs to commence formal procedures to get the sign reinstated. It is seriously harming the park and cannot be helping the Webbs get people into their fairground.

to right the sign use to been seen from anywhere and now all you see is the cinema fin looking bare. slightly off topic but now we know the reverse bungee might be taking the big wheels place, will they need to redo the whole planning application again since it isn't a big wheel?

It's up to the council now. Don't hold your breath waiting for them to take action, though.
